Statement of Undertaking

The applicant of ATA Carnet (“Carnet”) accepted and agreed online to be bound by the following terms and conditions upon the use of Carnet services, and assented to undertake any liabilities in relation to exercising the Carnet:
  1. To pay all duties, taxes and/or charges which may result from non-re-exportation from any destinations or failure to observe Customs regulations and requirements in both Hong Kong and abroad.
  2. To pay to the Hong Kong General Chamber of Commerce (“the Chamber”), before the ATA Carnet is issued, a security deposit or guarantee (“security”) issued by a Hong Kong licensed bank or insurance company, in such amount as the Chamber shall determine as reasonable, to cover any possible import duties or other liabilities that the Chamber may incur as a result of issuing this Carnet.
  3. To pay, on a full indemnity basis, all legal and/or other costs and expenses incurred by the Chamber in the recovery of all or any amounts paid by the Chamber under this Carnet and/or in enforcing the security.
  4. To authorize the Chamber to use the security for reimbursement of any duties, taxes, charges, legal and/or other costs and expenses as above-mentioned, and any fees charged by the Chamber for the issue of the Carnet.
  5. To reimburse the Chamber for any payments made on my behalf that may exceed my security amount.
  6. To pay the Chamber an administration fee for any regularization action taken by the Chamber and/or other parties.
  7. To provide documentary proof of the value of goods to the Chamber if required, allow the Chamber to carry out consignment inspections and/or appoint a third party professional to verify any information supplied by the applicant at the cost of Carnet applicant or holder.
  8. To limit the total value of goods per Carnet to HK$5 million and the number of line items to no more than 1000.
  9. To be held liable, myself and my representative(s), for non-compliance with the relevant laws and regularizations in the use of the Carnet, and for any goods covered by the Carnet which are destroyed, lost or stolen in any foreign countries.
  10. To return the full set of original Carnet documents, including all counterfoils validated by Customs authorities, as well as any unused vouchers and counterfoils to the Chamber upon completion of the last trip, or at the very latest before the Carnet expires. Provided that no unresolved discrepancies or omissions are found on the returned Carnet, the security will be conditionally discharged to the Carnet holder on a non-interest bearing basis.
  11. To permit the Chamber to withhold the security for up to a period of 31 months from the date of issue of the Carnet on a non-interest bearing basis, if any unresolved discrepancies or omissions are found on the returned Carnet. The security shall be returned upon the expiry of such period, provided that the Chamber receives no customs claims within the said 31-month period.
Notes:
  1. The Chamber reserves the right to refuse to issue or revoke any Carnet without giving explanation. Fees paid are non-refundable under all circumstances.
  2. Customs authorities have the right to accept, refuse or revoke any Carnet as they see fit.
  3. The Chamber is not liable to any claims under all circumstances in relation to exercising the Carnet.
The applicant declared that all information supplied and the descriptions of goods in the General List in connection with the application are true and correct, and is liable for prosecution under the laws of Hong Kong for making a false declaration.
